4.9) Group booking (from 6 rooms without package)
Special cancellation conditions apply. These vary depending on group size and scope of services and must be requested and agreed individually with the hotel.
4.10) The hotel does not charge any fees for rebookings. The following changes count as rebookings:
Names of the guests
Additional services (e.g. half board)
Arrival and departure dates within the booking period for an unchanged or extended length of stay
4.11) Cancellations must be made in writing without exception. A cancellation is valid upon the guest's receipt of a written cancellation confirmation from the hotel.
5) Withdrawal by the hotel
²5.1) If it was agreed that the customer may withdraw from the contract free of charge within a certain period, the hotel is entitled in this period to withdraw from the contract on its part if inquiries from other customers for the contractually booked rooms exist and the customer, when asked by the hotel, is not immediately prepared to make a firm booking.
5.2) If an agreed or requested advance payment or security is not provided by the customer, the hotel is likewise entitled to withdraw from the contract.
5.3) Furthermore, the hotel is entitled to withdraw from the contract extraordinarily for objectively justified reasons, in particular if:
- force majeure or other circumstances for which the hotel is not responsible make fulfilment of the contract impossible
- rooms or premises are booked culpably under misleading or false information or by concealing material facts; the identity of the customer, their ability to pay or the purpose of the stay may be material in this respect
- the hotel has justified reason to assume that the use of the service may endanger the smooth running of business, the security or the reputation of the hotel in public, without this being attributable to the hotel's sphere of control or organisation, the purpose or occasion of the stay is unlawful
5.4) Justified withdrawal by the hotel does not give rise to any claim for damages on the part of the customer.
6) Newspaper advertisements containing invitations to interviews or sales events generally require the prior written consent of the hotel. If a publication takes place without the hotel's consent, the hotel has the right to cancel the event; in this case clause 4 of the General Terms (payment of the rent and a fee) applies accordingly.
7) The hotel will endeavour to re-let hotel rooms or conference rooms that are not used, where possible. For the period of re- letting, all costs are waived. If the hotel has justified reason to assume that the event may endanger the smooth running of business, the security or the reputation of the house, as well as in cases of force majeure, it may cancel the event.
8) If the orderer has reserved several hotel rooms with the reservation of possibly using fewer rooms (block booking), the orderer must report the number of rooms actually required and the number of persons for the agreed date, at the latest 14 days before arrival. Upon receipt of the notification, the remaining rooms are released for other lettings. No costs arise for the orderer in this respect. If no notification is made, the entire block is charged to the orderer; clause 4 a-d applies and is deemed agreed. The named list of participants must be made available to the hotel up to 4 days before arrival.
9) Price adjustment clause
9.1) If more than 6 months lie between the conclusion of the contract and the provision of the service, the hotel reserves the right to make price changes that do not fall under 9.2 without prior notice. Changes in value-added tax are to the benefit or to the detriment of the guest/orderer, regardless of the time of conclusion of the contract.
9.2) Furthermore, the hotel reserves the right to adjust its prices to the development of costs. A price increase is considered, and a price reduction must be made, if, for example, the costs for the procurement of energy, water and other supply services increase or decrease, or other changes in the energy-related, supply-related or legal framework conditions lead to a changed cost situation. The price changes apply regardless of the time of conclusion of the contract.
9.3) Price increases of a maximum of 5% exclude a right of withdrawal.
10) All prices are in euros including value-added tax.
11) Included services offered, such as the use of the fitness studio, the sauna or the infrared cabin, are merely tolerated services for normal bookings (overnight stay with or without breakfast, see also clauses 4.1 to 4.3) and are therefore not obligatory services of the hotel and can only be used during the respective opening hours. This does not apply to package bookings; however, the opening hours are also decisive for use there.
12) For special prices and services that are merely advanced by the hotel (e.g. visitor's tax), credit cards (Visa, Diners and Eurocard) are not accepted.
13) If the contractual partner is a merchant, the place of jurisdiction is Gifhorn. For seminars, conferences, congresses and similar events, the following must also be observed:
14) The head of an event in the hotel is deemed authorised to make all declarations required within the organisation with effect for and against the organiser, unless the organiser restricts the head's authority by written declarations which must have reached the hotel before the start of the event.
15) A change in the number of participants for a joint meal must be communicated at the latest 2 working days before the start of the event; otherwise at least the ordered number of covers will be invoiced.
16) The organiser assumes joint liability for the payment of any additionally ordered food and drinks by the event participants.
17) Bringing in food and drinks requires the prior consent of the hotel.
18) If the consumption per person at an event is less than €15.00, room rental will be charged.
19) No liability is accepted for the loss, destruction or damage of items or exhibits that the organiser has brought into the conference rooms. All decoration material must comply with fire safety requirements.
20) Attaching decoration material or other objects is only permitted with the hotel's consent. For damage to the furnishings or inventory of the hotel caused during set-up or dismantling or during the event, the organiser is liable within the scope of the statutory provisions.
21) Faults in the technical or other equipment provided will be remedied immediately where possible. Any reduction comes into consideration only with regard to the rent attributable to the equipment provided.
22) The protection of your personal data during collection, processing and use in connection with your stay is an important concern for Hotel laVital. Your data is collected, processed and protected within the framework of the statutory provisions.
23) For package bookings or package travel, the guidelines of Directive (EU) 2015/2302 apply. These can be viewed in form sheet # at https://www.lavital.de/images/pdf/Pauschalreise_Richtlinien.pdf.
24) Should any provision of the General Terms be invalid, this does not affect the validity of the other provisions. In place of the invalid provision, a valid provision that comes as close as possible to it applies.
25) Deviating agreements or collateral agreements must be made in writing.
